VAT Exemption Property Turkey Foreigners: Who Qualifies?

Do foreigners pay VAT on property in Turkey? Sometimes yes, sometimes no. The answer turns on who the buyer is and whether the flat is a first delivery from the developer.

The same new-build flat can be sold with or without VAT. It depends on the buyer’s status and on how the payment arrives. The exemption is conditional, and it carries obligations after purchase. It is not a general discount for foreigners, and it is not an automatic right for every residence permit holder.

A residence permit is the document that allows a foreign national to live in Turkey. A building permit is the official approval to construct a building.

This article is for information only and is not tax advice. It replaces the familiar “big saving for every foreign buyer” marketing line with the real picture. The rule behind it sits in the VAT Law, article 13/i (3065 sayılı Katma Değer Vergisi Kanunu md. 13/i konsolide metin).

Do Foreigners Pay VAT on Property in Turkey? The Short Answer

The law exempts certain deliveries of homes and business premises from VAT. It covers only the first delivery of a newly built unit, and only where the price is brought into Turkey in foreign currency.

Do Foreigners Pay VAT on Property in Turkey? The Short Answer

“Depends on who the buyer is” has a specific meaning here. The law lists particular buyer categories, so a foreign passport is not enough on its own.

A second-hand flat falls outside the exemption. A 2023 source states that the exemption applies only to first delivery, that second-hand homes are outside it, and that the property must be registered at the title deed office, the state office that records ownership (Yabancıların Türkiye’deki Konut ve İşyeri Alımlarında KDV İstisnası). Because that source is dated, confirm the current position with an official body or adviser.

The law sets out conditions, and eligibility is decided on the facts of each case. Nothing here promises that you qualify.

VAT Exemption Property Turkey Foreigners: Which Buyer Groups Does the Law List?

Article 13/i of the VAT Law names three groups:

  • Turkish citizens who live abroad on a work or residence permit for more than six months.
  • Foreign individuals who are not settled in Turkey.
  • Institutions whose legal and business centre is outside Turkey.

“First delivery” means the first sale of a newly built home or business unit, as opposed to a later resale. A resale between private owners is a different transaction, and the exemption is not designed for it.

A February 2023 source describes the same groups. Where it overlaps with the text of the law, the law’s wording governs.

The six-month wording applies to Turkish citizens living abroad, not to foreign buyers. If you are a foreign individual, focus on the phrase “not settled in Turkey”.

Turkey New Build VAT Exemption Conditions: What Must Happen With the Money?

The legal condition is that the price is brought into Turkey in foreign currency. The law says nothing about banks or transfer routes, so this article does not either.

Turkey New Build VAT Exemption Conditions: What Must Happen With the Money?

Secondary sources report a staged payment rule. According to a February 2023 source, at least 50% of the sale price must be brought in as foreign currency before the invoice, and the remainder within one year. It traces this rule to a 2017 circular (Konut Tesliminde KDV İstisnası). We did not verify the current text of that circular for this article.

A July 2023 summary of a circular and a law firm’s note repeat the same staging. Treat it as reported guidance rather than settled fact.

Important note: Under the legislation in force at the date of publication, these steps are as reported above, and the rules can change. Confirm the current position with a licensed accountant or tax adviser before signing.

Turkey Property VAT Rate: What Applies If You Do Not Qualify?

If the exemption does not apply, the VAT rate depends on the size of the home. According to a July 2023 source, for homes with building permits dated after 1 April 2022, VAT is 10% on net area up to 150 m² and 20% on the part above that. Older sources may describe the rates differently, so check the current position with an official body or adviser.

Another report states that the tiered rate applies only to residential units with building permits dated after 1 April 2022, and that the Danıştay (Council of State) upheld the tiered application.

Our reading is that a blanket “save the full standard rate” claim can overstate the benefit for smaller homes, because the lower tier may apply to much of the price. This is an interpretation, not a statement from the sources.

Here is the calculation as a formula. It uses no prices or sample results, and it does not explain how net area is measured.

Example only; confirm with a licensed accountant: VAT due = 10% × [taxable amount for the part up to 150 m² net] + 20% × [taxable amount for the part above 150 m²].

The title deed fee is a separate charge and is not VAT. It is 2% each for buyer and seller, calculated on the declared price, which cannot be lower than the property tax value (492 sayılı Harçlar Kanunu, 4 sayılı tarife — mevzuat.gov.tr).

After Purchase: What Do the Resale Rule and Shared Liability Mean?

Your obligations continue after you buy. If you dispose of a home or business unit bought under the exemption within three years, the VAT that was not collected becomes payable. It is paid with deferral interest, before the title deed transaction.

After Purchase: What Do the Resale Rule and Shared Liability Mean?

This is the main correction to older English pages. Law No. 7394 (2022) raised the period from one year to three. Some older pages still show the shorter period, and those pages are outdated.

Shared liability is the second point. If the exemption was applied without the conditions being met, the seller and the buyer are jointly liable for the tax, the tax-loss penalty and late-payment interest. In practice, a mistake on the developer’s side can become your problem too.

Important note: Under the legislation in force at the date of publication, the rules are as described above, and they can change.

Non-Resident VAT Exemption Turkey Property: Does a Residence Permit Settle the Question?

Many foreign residents in Antalya hold residence permits. The law says a foreign individual must be “not settled in Turkey”.

The text of the law reviewed here gives no definition of “settled” for foreign individuals. The six-month wording belongs to Turkish citizens living abroad. For that reason, this article offers no test and no rule of thumb.

Holding a residence permit may not, by itself, settle whether a buyer counts as settled. That needs checking for each buyer, based on your own facts.

Ask a licensed accountant or tax adviser to confirm your own status before signing. Do not rely on a developer’s general assurance, and do not look for a workaround.

What Should You Ask the Developer Before You Sign?

Ask for each answer in writing:

What Should You Ask the Developer Before You Sign?
  • Is the flat a first delivery of a newly built unit?
  • Which of the three buyer categories applies to you?
  • How and when must the foreign currency arrive?
  • What is the date of the building permit? It decides whether the tiered rate applies, because the tiers cover permits dated after 1 April 2022.
  • What obligations continue after purchase?

On the deed itself, sale and transfer are completed at the title deed office with an official deed. A notary can only draw up a sales promise agreement (2644 sayılı Tapu Kanunu md. 26 — mevzuat.gov.tr).

If you are thinking about letting the flat, letting a home to users for up to 100 days is treated as tourism letting and needs permission from the Ministry of Culture and Tourism (7464 sayılı Kanun Resmî Gazete 2/11/2023, sayı 32357).

A note for readers who are also considering citizenship: the property route at 400,000 USD requires a three-year no-sale note on the title deed (Türk Vatandaşlığı Kanununun Uygulanmasına İlişkin Yönetmelik md. 20). This is a separate rule from the VAT resale rule above, and this article does not say the two can be combined.

Conclusion

The question of VAT exemption for foreigners buying property in Turkey has a conditional answer. The exemption depends on the buyer’s status, on how the payment is made, and on what happens after purchase. It is a conditional rule, not a general discount.

A final reminder: confirm your tax position with a licensed accountant before any contract is signed.

Frequently Asked Questions

What happens if I sell a flat bought with the VAT exemption soon after purchase?

Yes, under the legislation in force at the publication date, selling or otherwise disposing of the property within three years makes the uncollected VAT payable with deferral interest before the title deed transaction. This makes the exemption a poor fit for buyers who may need to sell within a short time.

Is there a limit on how much property a foreigner can own in Turkey?

Yes, under the legislation in force at the publication date, the total area a foreign individual acquires cannot exceed 10% of a district’s privately owned surface area, or 30 hectares per person nationwide. The President may raise the per-person amount up to double, which is 60 hectares.

Can foreigners buy property in every part of Turkey?

No, under the legislation in force at the publication date, foreign individuals and companies cannot acquire property in second-degree land military prohibited zones (2565 sayılı Askeri Yasak Bölgeler ve Güvenlik Bölgeleri Kanunu). The President may also decide that foreigners cannot acquire property in areas designated because they are close to military prohibited zones or for other strategic reasons.

What should I review before signing a new-build contract with a VAT exemption?

Reviewing the title deed record together with the developer’s written answers on your buyer status and payment timing is recommended. Confirm the current position with an official body or adviser before you sign.
